Legislation in family law

There are a number of statutes (laws) which govern the courts’ decision making process in England and Wales, the tenets of which will be applied to a case when it reaches a court hearing.

‘Case law’ is the body of legal decisions made by higher courts to establish a principle of law. It can be derived from the interpretation of statutes and is sometimes referred to as “precedent”.

Plus, family solicitors must abide by a number of statutory instruments which contain the rules and regulations for court procedure, such as the Family Proceedings Rules which sets out time limitations for presenting documents to court etc.

Solicitors’ code of conduct

All family solicitors (indeed all solicitors) must adhere to the Solicitors Regulation Authority Code of Conduct, which can be accessed here.

The Code provides regulations which will, when adhered to, provide benefit for and protect clients and the public. It provides ten ‘mandatory principles’ for solicitors which “define the fundamental ethical and professional standards” expected of law firms and individuals who provide legal services.
