Construction Case Studies
Case Study 1Advising a national demolition contractor involved in multi-party proceedings in the Technology and Construction Court over a period of 2 years, including a number of applications for injunctions, arising out of the construction of a high-rise office tower in the City of London. Issues included a substantial nuisance claim, water ingress, burst water main, damage to neighbouring property and business interruption.
Expert evidence was commissioned in the fields of acoustics, structural engineering, mechanical and electrical engineering and valuation. Negotiations included two complex and lengthy mediations involving approximately 50 professionals. The dispute settled before trial on the basis of the claimant accepting approximately 1% of its original claim and having to bear 90% of their legal costs themselves.
Case Study 2Dispute regarding accidental contamination by heating oil to a substantial domestic home and subsequent defective works carried out by the polluter’s insurers involving issues of latent and patent defects, exclusion and limitation clauses, delays, consequential losses and diminution in market value. The proceedings involved commissioning expert evidence in the fields of building and quantity surveying, environmental remediation and property valuation.
Case Study 3Acting on behalf of the contractor in proceedings in the Chancery Division and the Technology & Construction Court in relation to a luxury mixed residential and commercial development in Covent Garden. Issues included defective works and materials, significant alterations to the design of the building as a result of planning requirements, prolongation of the works consequent upon variations issued by the employer and related claims for extensions of time, LADs and cost and expense.
Case Study 4Advising high net work individuals in proceedings against a main contractor and warranty insurer involving substantial structural defects to a new high value domestic property located in Gerrard’s Cross. Issues included defective design, workmanship and materials, design and scope of the remedial work, appropriate professional supervision of same, exclusion clauses, delays and consequential losses.
Case Study 5Acting on behalf of a groundworks sub-contractor in a dispute with a developer involving a range of construction projects throughout the south east of England. Issues included variations, defective works, disputed final accounts, retentions, suspension of works by the contractor under Section 111 of the Construction Act 1996, inadequate remediation of contaminated brownfield land, asbestos contamination, claims for loss and expense including site preliminaries and overheads and diminution in market value.
Case Study 6Dispute between a national demolition contractor and a plant hire sub-contractor regarding a contract to demolish three substantial buildings in Glasgow, including an eight-storey tower block, involving the final account, delays and LADs.
