Dealing with asbestos related disease claims

Asbestos-related illnesses have caused the loss of hundreds of thousands of British lives, and with a further 45,000 deaths predicted by 2050, the march of this “hidden killer” shows no sign of abating.

Asbestosis is a long-term chronic lung condition. Symptoms include shortness of breath and a persistent cough. It is caused by inhaling asbestos fibres.

According to the Health and Safety Executive, in 2012 there were 980 newly assessed cases of this industrial diseases.

Anyone who has been diagnosed with this condition could be entitled to claim compensation from the individual or company who exposed them to this hazardous substance.

In many instances the person suffering from asbestosis will have been exposed to asbestos through a former employer.

The symptoms of asbestosis can take from 15 to 30 years to present themselves. At this point it can be difficult to locate the liable company, but the Lawyers at Healys Solicitors Recover can often, when companies are untraceable or have gone bust, ensure redress through the firm’s insurers.

    Dealing with Mesothelioma Claims

Mesothelioma is a devastating industrial disease which has left a profound and traumatic legacy for many families and communities in Britain. If you or a close family member has received a diagnosis of this asbestos-related illness, Healys Solicitors can bring the full weight of their expertise and experience to benefit your chances of making a successful mesothelioma claim.

Healys Solicitors helped the family of a carpenter claim compensation after he was diagnosed with Malignant Mesothelioma as a result of being exposed to Asbestos. Our client was working for a company during the period 1962 to 1972.  Over the course of his employment he was exposed to asbestos and was never instructed to wear safety equipment. The case was finally settled under the Fast Track Mesothelioma claims procedure we were able to secure our client’s widow £150,000 in compensation.

Mesothelioma is a type of cancer affecting the mesothelial cells which line the heart, lungs or abdomen. Because it is a terminal illness with no cure, any diagnosis of mesothelioma is going to cause trauma and uncertainty.

Although asbestos exposure is implicated in all these types of cancer, it is most frequently the cause of cancers in the lung lining (pleural mesothelioma).

If you have recently received a diagnosis of the illness, you will have many things to consider – not least your treatment options, which may include surgery, chemotherapy and radiotherapy.

However, you will also need to consider the financial impact of the illness and how you can best mitigate this. The industrial disease lawyers at Healys Solicitors Recover can bring clarity, conviction and assurance to the claims process to help you ensure the best possible chance of receiving suitable compensation.

    Who can claim?

Although any person who is suffering from the illness can claim, close relatives and dependents can claim too if the affected person has died within three years of the date of claim.

Electrician claims – During the 1950s, 1960s and 1970s many electricians were exposed to asbestos lagging and insulation in their workplaces.

Boiler maker and fitter claims – Until relatively recently many boilers were insulated with asbestos. The “laggers” who fitted these boilers have some of the highest rates of asbestos cancer.

Mechanics and automotive worker claims – Many brake pads and clutches in the past contained asbestos-based materials.

Plumber claims – Plumbers often worked with asbestos contaminated heating and insulation systems.

Joiners, carpenters, construction worker and ship builder claims – Many workers from these trades suffered a high incidence of asbestos dust exposure.
