Alternative dispute resolution (ADR), is a legal process, which includes a range of processes to find a resolution to a dispute, with the support of a third party.
Alternative dispute resolution assists disagreeing parties come to an agreement on a matter that cannot be resolved through pre-action discussion. ADR can save all parties involved time and expense by avoiding litigation and going to the court.
This process can usually be explored before or during a dispute.
There are five main types of alternative dispute resolution, which include:
- Mediation – a third party facilitating a resolution;
- Arbitration – a third party deciding the dispute;
- Early neutral evaluation – a third party giving an informed opinion on the dispute;
- Adjudication – a process by which an independent adjudicator provides the parties with a decision that can resolve the dispute either permanently or on a temporary basis, pending subsequent court determination; and
- Ombudsman schemes.
