How Do I Make a Personal Injury Claim?
When making a compensation claim for an injury, you need to prove that the other party was responsible for your injury. Taking photographs of the damage and accident location is a good way to prove your case, and also take photographs of any damage made to your property, or keep a hold of it if this is practical. Compensation is awarded for pain and suffering as a result of your injuries, and your inability to carry out tasks as before.
As well as claiming compensation for your injuries, you can also claim for financial loss suffered, for example treatment fees, aids and appliances, care and assistance, and domestic help. What are the Time Limits for Making a Personal Injury Claim?
For personal injury claims, proceedings should be commenced within three years of the date of the accident. This is known as the limitation period. In some circumstances the limitation period starts from the date the injury is identified, that is to say the date of knowledge rather than the date the accident occurred; for example in claims for work-related disease.
For the claimants under the age of 18, limitation runs from their 18th birthday.
In certain cases the courts have a discretion to waive the limitation period.
Making a Personal Injury Claim: The Legal Process
