Professional Negligence Case Study: Claims Against a Financial Advisor

This was a claim against a financial advisor arising out of their failure to advise our clients properly or at all when engaged to provide them with legal expenses that was suitable for their business and/or procure such insurance cover. The clients had expressly instructed the financial advisor to advise on and procure cover which extended to breach of contract in relation to their business. The financial advisor’s failure to do so meant that a claim which subsequently arose was not covered by their insurance policy. It was necessary to resolve this claim as part of pursuing the claim against the financial advisor.
