This article summarises the type of claims that we have pursued against estate agents. We shall be publishing similar articles in respect of the other professionals in the coming weeks.
 

Tenant security checks

Claim against a firm of estate agents arising out of their failure to carry out (1) proper (or any) due diligence on the tenant of our client's property in October 2017 and/or (2) sufficient (if any) security checks of the property. The Tenant proceeded to carry out illegal activities at the Property, namely converting the Property into a cannabis farm and thereby causing extensive structural and other damage. The Tenant also did not in any way clean or maintain the Property. The claim also involved coverage of the clients' insurance policies which could be voided as a consequence of the agent's failings.

Tenants

Professional negligence claim against an estate agents in respect of their failure to (1) obtain references for the tenant of the property; (2) obtain a deposit and rent in advance from the tenant; and (3) advise the client of the referencing circumstances of the tenant.

Lettings

Claim against an estate agents in respect of the manner in which they handled the letting of the client's property to include failing to (1) accurately inform the clients of the state of disrepair of the property and the terms of an extension of the tenancy agreement; (2) accurately and sufficiently undertake pre and post tenancy inspections; and (3) seek to recover funds from the tenants for repairs to the property.
