In business we are all routinely exposed to AI on a daily basis and there are significant legal consequences.

In the 30 years we’ve advised on Internet legal issues, our judgment is AI is the most consequential technology advance affecting business, not least due to the speed of its adoption.

No company has the luxury of time – but you do have access to knowledge.

Here is my list of top things that you should consider doing:

  • Prepare an inventory of what AI your business is using. It may be more than your employees simply using ChatGPT. Only by knowing what you are using, or intend to use, can you assess legal risk.
  • Before deploying an AI system, evaluate its technical promise, but also the legal terms of use, because you are assuming legal liability.
  • Check with us before you deploy any AI. We can provide an AI Legal Impact Assessment.
  • You need to know if the AI system is a high or low risk solution. AI output which has significant consequence to customers or staff, brings higher legal compliance and legal exposure. You may need to explain to those who are exposed to your AI that they are engaging with it, and how it arrives at its output.
  • You need a staff AI Use Policy.
  • You must map out the internal AI roles and functions within your company.
  • How will you ensure your intellectual property rights are secure if staff generate messaging using your company’s brand, or that your confidential information is not inadvertently gifted to the AI model?
  • If your AI is processing people’s personal data, there are significant Data Protection issues to consider.
  • We are all learning the societal and commercial impact of AI. There’s also a legal impact. Understanding it means you can embrace AI to gain commercial advantage, safely.
