Fraudulent property transactions have become more prevalent in recent years, with identity fraud emerging as an increasingly attractive option for criminals.   1. On purchasing a property, the client's solicitor (wrongly) paid the deposit and/or completion monies to the fraudster (and not the seller's solicitor).

  1. On selling a property, the client's solicitor intended to provide the client with the purchase monies by banker's draft (which is the equivalent of cash) but then lost that draft.

  1. On selling a property, the client's solicitor paid the deposit and/or completion monies to the seller's solicitor but who had employed a fraudster who was dealing with the transaction and who transferred the monies to his personal account and not to the seller.

  1. When seeking to purchase a property, the client sent the deposit monies to a fraudster pretending to be his solicitor.

While there may be a claim against the client's solicitor, it is challenging on the facts because the client was warned not to accept a change of bank details by e-mail. However, there is potentially a much better claim against the client's bank following a recent Court of Appeal decision. This is an ongoing matter being dealt with by Robert. All the clients were extremely pleased by Robert's knowledge, energy, technical expertise, service levels and which all contributed to extremely favourable outcomes.
