The claim arose from the manner in which the Architects in question (the defendants), dealt with the demolition of a then existing building and the erection of a detached single two-storey dwelling with access, parking and amenity at our client’s property. This project was intended to be the client’s dream home.
Robert argued that the assigned architects had failed their client by:
- Not ensuring that the Property was built in accordance with (inter alia) Building Regulations;
- Allowing certain insulation material to be used which was contrary to the specifications for and on which planning permission was sought and obtained;
- Failing to manage, supervise and advise the client in respect of one of the construction contractors; and
- Failing to manage and advise the client on the project generally with sufficient skill and care.
Robert successfully settled the case for his client during the pre-action period for the majority of the claim and costs. This was achieved within the cost budgets given and time frame provided at the outset.
After the settlement the claimant said:
“I consulted Healys over a professional negligence claim in late 2019. Robert Johnson took a keen and close interest in my case, and gripped it completely. His advice was professional, pragmatic and no-nonsense. He gave me a realistic and sensible view of the likelihood of success (entirely borne out by the ultimate outcome) and then pursued matters with care and diligence, keeping me closely informed of all material developments, and chasing our opponents when it looked as if unreasonable delays were being experienced. I felt I was in the safe professional hands of someone who understood and shared my concerns, and I was entirely satisfied and pleased with the services I received.”
