Case Study: Professional Negligence Claim against Architect

Robert Johnson, Partner and Head of Professional Negligence at Healys LLP, successfully represented a claimant win a professional negligence claim against a firm of Architects.The claim arose from the manner in which the Architects in question (the defendants), dealt with the demolition of a then existing building and the erection of a detached single two-storey dwelling with access, parking and amenity at our client's property. This project was intended to be the client's dream home.

Robert argued that the assigned architects had failed their client by:

• Not ensuring that the Property was built in accordance with (inter alia) Building Regulations;
• Allowing certain insulation material to be used which was contrary to the specifications for and on which planning permission was sought and obtained;
• Failing to manage, supervise and advise the client in respect of one of the construction contractors; and
• Failing to manage and advise the client on the project generally with sufficient skill and care.

Robert successfully settled the case for his client during the pre-action period for the majority of the claim and costs.
